Notice of Colgate and Tom’s of Maine Recyclable Toothpaste Tubes California Class Action

PR Newswire

SAN FRANCISCO, Oct. 27, 2026 /PRNewswire/ —

This class action lawsuit may affect your rights. Please read this notice carefully.

This notice provides information about Gershzon, et al. v. Colgate-Palmolive Company, Case No. 3:23-cv-04086 (N.D. Cal.), a consumer class action lawsuit alleging that Colgate-Palmolive Company (“Colgate”) mislabeled certain Colgate and Tom’s of Maine toothpaste tubes as recyclable on the outer package when they were allegedly not accepted by recycling programs in California. Colgate denies these allegations and maintains that the tubes are recyclable. The United States District Court for the Northern District of California has certified a Class of California purchasers who purchased certain Colgate or Tom’s of Maine toothpaste products labeled on the outer packaging as having a “Recyclable Tube.” It has not made a determination regarding the merits of Plaintiffs’ claims or found Colgate liable.

Does the Class include me?

The Class includes all persons who purchased, in the State of California, Colgate or Tom’s of Maine brand toothpaste products with the language “Recyclable Tube” on the outer package (“Products”) between August 29, 2019, and October 26, 2026, except for MaxFresh 6 oz. (UPC No. 35000764522); MaxFresh 6.3 oz. (UPC No. 35000996671); and Tom’s of Maine Sensitive Rapid Relief Toothpaste Fresh Mint Fluoride (UPC No. 77326835623).

What are my rights?

You have two options:

  1. Do nothing: If you are a member of the class and do nothing, you will remain in the Class, you will keep the right to a share of any money (if any) that may come from a trial or settlement of the Class’s claims in this lawsuit against Colgate. You will not be able to start another lawsuit, continue another lawsuit, or be part of any other lawsuit against Colgate based on the same legal claims. All the Court’s orders and judgments in the case relating to the Class will apply to you and legally bind you. If Plaintiffs do not prevail, you will also be bound by the judgment.
  2. Opt-out: You can exclude yourself (opt-out) of the Class if you wish to retain the right to sue Colgate separately for the claims in this lawsuit. If you exclude yourself from the Class, you won’t get any money or benefits that the Class may recover, even if Plaintiffs obtain them as a result of trial or from any settlement between Colgate and Plaintiffs. If you opt-out, you will not be legally bound by any of the Court’s orders related to the Class or any judgment or release entered in this class action related to the Class, and you may be able to file an individual lawsuit against Colgate about the legal claims brought on behalf of the Class. If you are unsure about what to do, you may want to talk to your own lawyer. You will be responsible for the cost of any services provided by your own lawyer.

You can exclude yourself from the Class (i.e., “opt-out” of the Class) by going to www.RecyclableToothpasteTubeClassAction.com and filling out the online form, or by sending a letter via first-class U.S. mail stating that you want to exclude yourself from the Class in Gershzon, et al. v. What will happen next?

The parties will continue to prepare the case for trial, unless the case is resolved by the Court or the parties before trial.

You don’t need to attend any hearing(s) or the trial, but you are welcome to attend if you want. If there is a recovery from the trial or a settlement, you will be notified about how to make a claim for payment.
