New Comparative Negligence Rules Present New Challenges for Florida Injury Victims, Says Cohen & Juda, P.A.
PLANTATION, Florida – In a significant shift for personal injury law, Florida adopted a modified comparative negligence standard on March 24, 2023, with the passage of HB 837. This change replaced the state’s previous pure comparative negligence system, marking a pivotal moment for negligence claims in Florida.
Under the 2023 law, if found to be more than 50% at fault for their own injuries, personal injury victims cannot recover damages. The law contrasts with the previous system, where victims could recover damages even if they were primarily at fault, with their compensation reduced proportionally to their degree of responsibility.
Attorneys Harvey M. Cohen and Gary H. Juda of Cohen & Juda, P.A., explain how this new standard has changed the landscape for accident victims and their firm’s strategies for pursuing fair settlements for clients.
“Insurance carriers are likely to defend claims by attempting to place greater responsibility on the injured claimant,” Cohen explained. “We’ve adapted our approach to defend our clients from such tactics, fighting more strategically and aggressively for compensation despite the higher bar for recovery.”
“This change has profound implications for personal injury victims,” said Gary H. Juda. “While it aligns Florida with the majority of states, it also underscores the importance of having experienced legal representation to navigate these new complexities. Our firm is committed to helping victims fully understand their rights and pursuing the compensation they need after an injury, even under this stricter standard.”
The modified comparative negligence law applies to all negligence claims filed after March 24, 2023, except for medical malpractice cases, which remain under the pure comparative negligence standard.
